This corporate political activity policy governs contributions to candidate campaigns and to entities operating under Section 527 of the Internal Revenue Code. It describes the criteria for contributions made with corporate funds and the process for approving and reporting such contributions.
FirstEnergy Corporate Political Contributions - Process and Criteria
Any request to FirstEnergy for a contribution to a candidate campaign or an entity operating under Section 527 of the Internal Revenue Code shall be submitted to the Governmental Affairs Department. The Governmental Affairs Department will review the request to confirm that the contribution is consistent with FirstEnergy's corporate strategy and complies with applicable election laws and regulations. The Governmental Affairs Department will keep accurate records of such corporate political contributions and take actions to ensure that a report (the "Report") is published annually, including for each contribution the amount and the name of the recipient. If the recipient is a candidate for office, the Report will also include the party of the candidate and the name of the office. FirstEnergy is a member of certain trade associations that may use a portion of their membership dues for political contributions. In the event that such trade associations inform FirstEnergy of the amounts and other breakdowns associated with political contributions, the Governmental Affairs Department will incorporate such information in the Report, subject to reasonable de minimis limits.
On an annual basis, the Audit Committee of the Board (or such other Board committee that FirstEnergy deems appropriate) will review the policy and the contributions described above.
